Callan G. Stein is a partner in the Health Sciences Department and the White Collar Litigation and Investigations Practice Group of Pepper Hamilton LLP, resident in the Boston office. Mr. Stein focuses on white collar criminal defense, corporate and commercial civil litigation, internal investigations and health care litigation.
Mr. Stein regularly defends corporations, corporate officers and directors, governmental and public employees, and other individuals accused of, or being investigated for, alleged white collar crimes. His experience includes matters involving alleged state and federal False Claims Act violations, health care fraud and abuse, securities fraud, mail fraud and wire fraud, racketeering and RICO violations, and violations of food and drug laws. Mr. Stein defends companies and individuals during all stages of the criminal process, including responding to government requests for information that typically signal an active or potential investigation, such as HIPAA subpoenas, administrative subpoenas, civil investigative demands, grand jury subpoenas or search warrants.
Mr. Stein also conducts internal investigations for corporate clients, including those in the health care industry. He advises clients that have learned of possible violations of fraud and abuse laws or health care regulations on how to respond, and he guides clients through thorough investigations that address the allegations. Using his in-depth knowledge of how prosecutors and regulators approach such allegations, Mr. Stein handles investigations relating to the most complex and sensitive issues.
Mr. Stein has a particular focus in the area of health care litigation. He represents health care providers charged with, or being investigated for, criminal and civil health care fraud and abuse, including violations of the False Claims Act, Anti-Kickback Statutes, HIPAA and the Stark Law, as well as Medicare and Medicaid fraud claims. Mr. Stein also represents health care facilities, providers, practices and medical staffs involved in third-party payor disputes, utilization review management issues and medical staff credentialing issues. As part of his health care litigation practice, Mr. Stein has represented health care facilities and other health care employers in employment-related litigation alleging violations of state and federal health care whistleblower laws, credentialing disputes and physician disciplinary matters.
