Even if the patent owner is not able to persuade the board to allow the amended claim, providing a chance to respond creates a record for appeal, letting the patent owner make its case to the Federal Circuit, said John P. Isacson of Pepper Hamilton LLP.
“You want to be able to get in your best arguments to hopefully convince the board,” he said. “But if you don't, at least you want to be able to get any evidence in there, so the Federal Circuit can look at it and decide whether the board made a proper decision or not.”
