David B. Stratton, a partner in Pepper Hamilton's Corporate Restructuring and Bankruptcy Practice Group and the managing partner of the firm’s Wilmington office, was quoted in the August 6, 2018 Law360 article, "Del. Ch. 11 Court OKs Hearing on Weinstein Contract Rules."
David B. Stratton of Pepper Hamilton LLP, counsel for Lantern Entertainment LLC, said he originally proposed an expedited hearing on the procedures for Aug. 17, but settled on Aug. 23, within the court's regular notice window.
Stratton said the compromise requires resolution of contract assumption disputes by Nov. 8, a potentially daunting schedule if 20 or more contract-holders dispute their treatment and Lantern’s position and seek a formal, adversary process before Judge Walrath.
"We're not trying to steamroll anybody. We're not trying to gain advantage," Stratton told Judge Walrath. "We just need to get this organized in a way that's efficient for the parties and, more importantly, for Your Honor."
Stratton said more than 91 contracts were at issue at one time. While agreements have resolved the bulk of those, he said, dozens might remain unsettled.
Stratton said the schedule anticipates changes in dates, but told Judge Walrath that "We need to get this boat launched before September."
