"The state AGs and FTC have argued their consumer protection laws would cover the alleged failure to have adequate measures to protect against breaches. The Uber resolution, which contains affirmative obligations, starts to put some meat on the bones around what states expect some of those measures may look like," said Pepper Hamilton LLP partner Barry Boise. "Although these decrees do not establish the law for others, it does start what can become industry standards – and certainly that is the goal of the attorney generals in this and other contexts."
