Against the backdrop of the U.S. Department of Education, Office for Civil Rights’ September 2017 Q&A on Sexual Misconduct; the Department’s November 2018 proposed amendments to the regulations implementing Title IX; and more than 113,000 public comments on the topic, we explore the practical steps colleges and universities can take to ensure they are providing a fundamentally fair process to students accused of sexual misconduct. We also provide guidance on how colleges and universities can better position themselves to respond when the final regulations are announced, while avoiding the pitfalls of prematurely overhauling their current policies in reaction to the draft regulations.
