Government Contracts Cyber Café Series: Recent Decisions Stemming from Protest Litigation Regarding Cyber Requirements

Speakers: Hilary S. Cairnie and Heather Engel

3/19/2019
8:30-9:15 AM (ET) | 5:30-6:15 AM (PT)

Join us for the third installment of our 2019 webinar series covering the top issues in government contracts and cybersecurity — all in just 45 minutes. The Government Contracts Cyber Café provides coaching, training and analysis to help you work through the technical, legal, accounting and other requirements confronting your organization, with the goal of helping you achieve compliance with the current DFARS and FAR cyber rules, regulations and contract clauses.

For this webinar, we are shifting our focus from the nuts and bolts embodied in the DFARS and FAR cyber clauses and will be examining a few recent decisions stemming from protest litigation involving the agency’s interpretation of selected cyber requirements and its evaluation actions, which adversely impacted one or more offerors. While not definitive of what all agencies will do in all acquisitions, these protest decisions do suggest a trend and, more importantly, how the GAO and the COFC may view agency discretion when it comes to matters of cybersecurity.

In this session, Hilary Cairnie, chair of Pepper Hamilton's Government Contracts Practice Group, and Heather Engel, chief strategy officer for cybersecurity firm Sera-Brynn, discuss these topics.
