Government Contracts Cyber Café Series: Recent Decisions Stemming from Protest Litigation Regarding Cyber Requirements

For this webinar, we are shifting our focus from the nuts and bolts embodied in the DFARS and FAR cyber clauses and will be examining a few recent decisions stemming from protest litigation involving the agency’s interpretation of selected cyber requirements and its evaluation actions, which adversely impacted one or more offerors. While not definitive of what all agencies will do in all acquisitions, these protest decisions do suggest a trend and, more importantly, how the GAO and the COFC may view agency discretion when it comes to matters of cybersecurity.
