Estate planning has always been an area of the law steeped in tradition and formalities. But as technology has evolved and become intertwined in our everyday lives, individuals have begun to abandon some of these formalities by instead turning to electronic mediums to prepare and store their wills. Electronic wills have truly shaken up the estate planning world, and states, courts and practitioners have struggled with how to adequately deal with electronic wills. With very few states enacting any kind of electronic wills legislation, the Uniform Law Commission has undertaken the task of drafting a Uniform Electronic Wills Act to address the use of validity of electronic wills.
The discussion will dive into the current state of the law with respect to electronic wills both in Pennsylvania and throughout the United States. The speakers will discuss the current version of the Uniform Electronic Wills Act, the current case law that has attempted to address the use of electronic wills, the policy considerations both for and against electronic wills, and some of the electronic wills statutes throughout the country that have already been enacted.
