Many people know about Harvey Weinstein’s legal troubles – and his well-documented history with women. But not everyone is aware of the many ethics issues raised by the conduct of members of his legal team, beginning years ago and continuing, most recently, with his trial counsel. Can a lawyer with a long history of advising victims in sexual harassment matters switch sides to represent an alleged harasser? Should she? Is a conflict presented because a lawyer entered into a business relationship with her client before she agreed to provide legal services? If a lawyer is providing primarily consulting and public relations services, are her communications with her client protected by the attorney-client privilege? Should an attorney subject to a non-disclosure order accept an interview with the press and then misstate what happened when the judge asks questions about it?
Our speakers will examine these issues by viewing news clips, social media posts and book excerpts as well as listening to podcasts. They will ask for your input and provide guidance for addressing these types of ethical issues when they arise.
