When Business Goes Digital, Does Competition Law Still Apply?
You have set up an e-platform or are using an existing one to undertake your business. As you do your business, you gather data about your customers. Overtime, algorithms can work such data to better enhance your sales. Will you be subjected to competition law concerns? Can you be taken to task for cartel behaviour or even an abuse of conduct as you better assess your customer and are able to sell more effectively? After some time, you decide to merge with another entity, and together, the quantum of data you have increases multi-fold. Will you be subjected to merger control?
