Pepper’s experience in the midstream sector includes the following:

  • defending midstream companies from a wide variety of claims brought in state and federal courts in Pennsylvania, West Virginia and elsewhere, including claims for breach of contract for violations of right-of-way/easement agreements, negligence, fraud and trespass; claims brought under states’ hazardous sites cleanup acts; claims for improperly placed pipelines; and private and public nuisance claims for activities related to pipeline construction and the operation of facilities such as fractionator plants and compressor stations, including for noise, dust and release of hazardous materials
  • defending a major midstream company in defeating an injunction action brought in federal court by a landowner attempting to stop access to and work on his property related to the repair of a pipeline rupture
  • handling all aspects of several multibillion-dollar pipeline projects spanning numerous states, including putting protocols in place for activities in Pennsylvania, West Virginia, Ohio and elsewhere for issues ranging from acquisition of options for rights-of-way to drafting construction documents
  • advising pipeline companies regarding the viability of eminent domain and pre-condemnation activities in Pennsylvania, West Virginia, Ohio and elsewhere
  • negotiating with landowners on pre-litigation matters involving all manner of potential claims
  • analyzing and drafting gathering agreements and other commercial agreements
  • advising a leading processor of natural gas liquids on the successful development of a rail-truck intermodal facility
  • advising a limestone producer on the development of a natural gas pipeline providing a direct connection with an interstate pipeline
  • advising a trucking firm on the development of a new rail line designed for the transportation of natural gas liquids.
