Marc D. Machlin is a partner in the Washington office of Pepper Hamilton LLP.  He is the head of the Regulatory Section within the firm’s Commercial Litigation Practice Group. He also chairs Pepper’s Transportation Industry Group, and he co-chairs the firm’s Energy Industry Group. Mr. Machlin is a member of the firm’s Sustainability, CleanTech and Climate Change Team. His practice covers a broad range of areas, including:

  • environmental and energy
  • infrastructure projects and renewable energy projects
  • transportation and NHTSA
  • antitrust, trade regulation, and consumer protection
  • public utility regulation, telecommunications regulation, and railroad regulation
  • product safety.

Mr. Machlin represents clients in connection with many types of infrastructure projects. These include cogeneration, solar energy and other renewable energy projects.

He regularly represents clients on transactions that require regulatory approvals or that have regulatory implications.

Mr. Machlin also represents clients before many federal agencies, including, but not limited to, the U.S. Department of Transportation, the U.S. Environmental Protection Agency, the U.S. Department of Energy, the Federal Energy Regulatory Commission, the Consumer Product Safety Commission, and the Federal Trade Commission. He also represents clients before state agencies, including public utility commissions and state environmental agencies.

Mr. Machlin represents clients in connection with government investigations and enforcement actions. He also represents clients in rulemaking proceedings, permitting, and related appeals.

Mr. Machlin has successfully negotiated with state and federal regulators and has advised clients on a wide variety of consent orders and settlement agreements.

Mr. Machlin is a member of the Energy Bar Association, the ABA Section of Public Utility Law, the ABA Section of Antitrust Law, the ABA Section of Natural Resources, Energy and Environmental Law, and the Association for Transportation Law, Logistics and Policy.
