David M. Magee is of counsel in the Intellectual Property Department of Pepper Hamilton LLP, resident in the Boston office.

Mr. Magee represents clients in disputes before the International Trade Commission (ITC), the U.S. district courts, and is experienced in prosecuting inter partes review (IPR) challenges before the Patent Trial and Appeals Board (PTAB) in Washington D.C.

Mr. Magee’s experience spans industries including:

  • technology: semiconductor layout, laser surface texturing and fabrication, mobile device componentry and applications, networking, fiber optic communications and infrastructure and liquid crystal displays 
  • medical devices: technologies and systems related to cryoablation, renal denervation, heat treatment ablation, endoscopy, multilumen catheters, stents, laparoscopic and direct visualization systems, spinal cord stimulators, pain pumps, morcellators and tissue removal systems, renal gel isolation, automated pathology staining systems, remote patient monitoring and diagnosis
  • software: operating systems, encryption, cryptocurrency and blockchain technologies, biometrics, differential updating and voice recognition algorithms
  • energy: gas turbines, photovoltaics, fuel cells, subsea drilling and pressure control systems
  • transportation and industrial: high bypass turbines, heavy mining, agricultural and forestry equipment, material coatings and laminated glass manufacture
  • entertainment: advertising and online broadcasting
  • sporting goods: lacrosse and hockey equipment.

Prior to joining Pepper, Mr. Magee was an attorney with Bingham McCutchen, LLP in Boston where he was responsible for the management of intellectual property and commercial litigation as well as technical based government investigations. Specific matters included investigations by the DOJ, FTC, European Commission and Japanese Fair Trade Commission (JFTC) relating to clients’ standard setting and patent licensing practices. Mr. Magee also represented joint venture contractors and subcontractors in various False Claims Act investigations and litigation arising from the design and construction of Boston’s Central Artery/Tunnel Project ("Big Dig") as well as serving as a technical lead attorney in investigations and defense of claims stemming from the accident onboard the Deepwater Horizon drilling platform and the resulting hydrocarbon release into the Gulf of Mexico.

Prior to law school, Mr. Magee was an engineer with an international engineering firm.
