Mr. Marion’s experience includes:

  • obtaining a $3 million arbitration award for an international client in a dispute regarding the respondent’s performance of its obligations under a software license agreement
  • successfully defending two separate clients in patent infringement litigation and prevailing on post-trial motions to deem the cases “exceptional,” entitling his clients to recover millions of dollars in attorney’s fees and costs they incurred in the lawsuits
  • obtaining a jury verdict on behalf of a clothing manufacturer against the supplier of defective yarn used to manufacture sweatshirts and other items that were then sold to Tommy Hilfiger and others
  • representing and advising the U.S. subsidiary of an international transportation company in breach of warranty, bid protest, negligence and other claims and matters
  • representing various clients in prosecuting and defending non-compete and misappropriation of trade secrets cases
  • serving as outside general counsel of a nonprofit organization that develops and administers licensing examinations for podiatrists
  • representing franchisors in the quick-service and fast casual restaurant and hospitality industries in a wide variety of litigation and arbitration proceedings throughout the United States
  • defending a wide variety of manufacturers of consumer products and industrial equipment in product liability litigation throughout the United States
  • defending a large manufacturer of exercise equipment in a securities class action arising from the client’s decision to take itself private
  • serving as active member of a team of lawyers who successfully recovered more than $5 million in payments that had been paid out by the claims office overseeing the BP/Deepwater Horizon oil spill matter based on fraudulent claims
  • successfully defending an injunction action which sought to prevent his client from using the name it chose for its seafood restaurant.
