Sharon R. Klein Quoted in Law360 Article, 'HHS Pact Shows Data Breach Reporting Can't Fall Off Radar'

Sharon R. Klein (CIPP/US), a partner in the Corporate and Securities Practice Group of Pepper Hamilton, the chair of the firm's Privacy, Security and Data Protection practice and a co-chair of the Digital Health Practice Group, was quoted in January 17, 2017 Law360 article, "HHS Pact Shows Data Breach Reporting Can't Fall Off Radar."

"The recent OCR settlement with Presence is a wake-up call to hospitals that delay in reporting PHI breaches violates HIPAA and puts patients at risk of potential harm," said Sharon Klein, who chairs Pepper Hamilton LLP's privacy, security and data protection practice.

Under HIPAA, covered health care providers, clearinghouses and health plans are required to notify affected individuals, the regulator and the media of breaches that affect more than 500 individuals "without unreasonable delay and in no case later than 60 calendar days after discovery of a breach."
