"The office tried to be responsive to the comments they received and they're adopting a more flexible approach," Reza Mollaaghababa of Pepper Hamilton LLP said.
Mollaaghababa said that although the less restrictive rules will clearly help applicants who want to overcome disclosures filed after their own disclosures, there are many unanswered questions about how the system will work in practice that will likely have to be sorted out through the courts.
"The exception is fraught with danger for inventors because it may provide a false sense of security that your own disclosures can shield you," he said.
