Matthew H. Adler Quoted in Law360 Article, 'Attys React to Supreme Court's DirecTV Arbitration Decision'
Matthew H. Adler, a partner and co-chair of Pepper's Commercial Litigation Practice Group, was quoted in the December 14, 2015 Law360 article, "Attys React to Supreme Court's DirecTV Arbitration Decision."
"Today's decision in DirecTV is the latest confirmation that in this Supreme Court, a ban on classwide arbitration is like Superman: bullets keep bouncing off of its chest. Classwide arbitration bans here survived a challenge with roots in both federalism and party autonomy, two doctrines that usually prevail. States, whether directly through their legislatures or indirectly through parties’ incorporation of state law, are powerless to overcome class action arbitration bans. The only path to any legal change will be at the federal level, which makes the upcoming battle of Consumer Financial Protection Bureau rulemaking on class action bans extremely significant."
