Ira Schulman, a Manhattan-based construction attorney, said it's not unusual for project labor and collective bargaining agreements to require the contractor pay into benefits funds for more than one union, even though only one trade is actually performing certain tasks.
It's also not uncommon for unions and contractors to dispute those contribution amounts.
"Many times, these cases just come down to a battle of the auditors," Schulman said, noting the payment is based on hourly wages. Typically, he said, both sides will ultimately negotiate to reach a deal on how much the contractor will pay.
