A. Christopher Young Quoted in Cook County Record Article, 'KFC Wins Right to Restrict Halal Advertising; Case Reminds Franchisees of Parent Brand's Contract Rights'
A. Christopher Young, a partner with Pepper Hamilton and chairman of the Franchise, Distribution and Marketing Section of the Commercial Litigation Practice Group, was quoted in the March 20, 2018 Cook County Record article, "KFC Wins Right to Restrict Halal Advertising; Case Reminds Franchisees of Parent Brand's Contract Rights." The article discusses an Illinois federal judge's ruling that a franchisor has the absolute right to control its franchisees’ advertising of the products and services offered under a franchise.
In light of this decision, franchisees will need to ensure they follow the contract they signed, said attorney A. Christopher Young, of the firm of Pepper Hamilton LLP.
"Franchisees need to understand that, by doing business as a franchisee, they will need to cede control of advertising and setting quality product and service standards to the franchisor for the sake of uniformity," Young said.
