The U.S. Supreme Court’s groundbreaking TC Heartland decision changed the game for where you can file patent litigation. Since the decision was issued earlier this year, we have seen an increase in patent litigation in Delaware and expect the number of cases to rise in the future. To succeed in this new environment, litigants need to understand the nuances of Delaware courts, from the judges to the rules and procedures. Pepper has a seasoned national patent litigation team who work closely with our attorneys in our Wilmington office on a number of cases.
