You may be familiar with the news stories about these high profile people that have captured the attention of the national news in the past few months. The Rules of Professional Conduct and attorney-client privilege are implicated in many of these stories. For example, did David Boise develop a conflict of interest relating to his long-time representation of Harvey Weinstein? Did Michael Cohen act ethically when he allegedly paid settlement funds out of his personal account? And should Michael Avenatti be speaking to the press about his client, Stormy Daniels, or is he bound by the Rules of Professional Conduct to remain silent?
In this CLE, we will examine some of the recent headline-making news stories and discuss which Rules of Professional Conduct apply. The presentation will include clips of news stories, both in print and broadcast form. We will explore where the lawyers in each of these cases went wrong, and how they could have avoided some of the potential issues raised by their conduct.
