The Volkswagen emissions cheating scandal was a headline-making event, in part, due to its scope. Even the company’s in-house legal department was involved. The challenges and pitfalls the law department confronted are no different than those that we all face in the course of our practice. This CLE will use the VW scandal as a vehicle to explore the following ethical issues:
- Rules of Professional Conduct 1.13 (Organization as Client), 3.3 (Candor Towards the Tribunal), 3.4 (Fairness to Opposing Party and Counsel), 5.1 (Responsibilities of Partners, Managers and Supervisory Lawyers) and 5.2 (Responsibilities of a Subordinate Lawyer);
- Treatment of potential evidence, including spoliation and litigation hold issues, and
- Business ethics in the context of corporate decision-making.
The program is approved for one (1) MCLE Ethics credit in California, New Jersey (through reciprocity), New York and Pennsylvania. Credit for other jurisdictions may be available upon request.
