Yvonne M. McKenzie, a partner with Pepper Hamilton and member of the Health Effects Litigation Practice Group and the Food and Beverage Industry Group, will speak at the Food and Drug Law Institute’s (FDLI) annual Enforcement, Litigation, & Compliance Conference taking place December 6-7 in Washington, D.C. Ms. McKenzie will join the panel entitled "FDA Regulation, Competitor Actions, and Private Litigation" on December 6 from 3:00-3:55 PM.
In the food industry, labels and label claims have garnered enforcement actions from FDA, other government agencies, competitors, and private litigants. A company could find itself in the midst of all of the above, based on a single claim on one product. This panel will discuss key techniques to prevent or minimize risk of an enforcement action by a government agency – FDA or otherwise – and subsequent action by a private actor. It will also discuss what other industries can learn from what has happened in the food industry.
