Ethical issues invade every aspect of the practice of law. Court rulings on these issues are enlightening and sometimes surprising. This seminar is the second in the popular format in which will describe the facts of several recent cases and ask you to vote on the outcome. We then will compare the vote to the actual outcome of the case, explaining the reasoning and applicable rules. Issues will include: the imposition of sanctions; the consequences of thrust-upon conflicts; the value of engagement letters in resisting claims of malpractice; disqualification; communications with represented parties; ethical issues in negotiations; and champerty (yes, champerty).

The program moderators will include:

William J. Brennan, IV: Mr. Brennan is a partner with Pepper Hamilton LLP and a member of the firm’s Litigation and Dispute Resolution Department. He represents clients in matters related to commercial, antitrust, construction, toxic tort, patent and environmental litigation, with a particular emphasis on products liability litigation. His practice often involves complex legal, scientific and technical issues. Mr. Brennan is a member of the firm’s Professional Responsibility Committee.

Hope A. Comisky: Ms. Comisky is a partner in the Philadelphia office of Pepper Hamilton LLP. She is a member of the Labor and Employment Practice Group and has extensive experience providing training and advice to clients as well as litigating employment-related disputes. She serves as the firm's Professional Responsibility Counsel, providing advice on all aspects of the Rules of Professional Conduct and related issues. Ms. Comisky also is vice-chair of the Professional Responsibility Committee at Pepper and a member of the Office of the General Counsel.

Thomas E. Zemaitis: Mr. Zemaitis is a partner in the Philadelphia office of Pepper Hamilton LLP. He is a member of the Commercial Litigation Practice Group where his practice concentrates in all types of commercial litigation, with an emphasis on intellectual property, antitrust and trade regulation matters. His experience also includes securities, trade secrets, contract and product liability cases. Mr. Zemaitis serves as chair of the firm's Professional Responsibility Committee and as a member of the Office of the General Counsel, providing advice on both risk management and professional responsibility issues.
