Charles E. Leasure, III

Charles E. Leasure, III has over 20 years experience practicing insurance and reinsurance law and provides a full range of litigation, arbitration and counseling services. His clients include insurers, reinsurers, reinsurance intermediaries, insurance brokers, and reinsurance pool managers. Mr. Leasure handles a variety of complex commercial insurance and reinsurance litigation at the trial and appellate levels of state and federal court as well as cases before ARIAS arbitration panels. He provides claims and state regulatory advice to insurance and reinsurance companies and brokers. Mr. Leasure counsels non-insurer corporate clients regarding risk management, with a specific interest in insurance placement and protection including self-insurance. He also is a licensed insurance producer in Pennsylvania and helps clients procure appropriate insurance and reinsurance cover.

Mr. Leasure focuses his practice in the following areas:

  • reinsurance arbitration, litigation, claims representation and dispute resolution
  • insurance coverage litigation, including representation of primary and excess insurers in environmental, asbestos, products, bad faith and other latent or mass tort claims at the trial and appellate levels
  • evaluation of insurance and reinsurance business practices arising out of the presentation of latent or mass tort claims
  • insurance insolvency, including run-off claims adjudication and counseling risk management and compliance counseling for financial services and corporate clients
  • corporate insurance purchasing, counseling and negotiation, with an emphasis on D&O and E&O coverages for financial services companies
  • strategic counseling for a wide range of issues involving commercial insurance policies, including general liability, directors and officers insurance, mergers and acquisition insurance, and representation and warranty insurance
  • merger due diligence and valuation of claims, with a specific emphasis on reconciling insurance programs and indemnity clauses.
The following engagements are representative of Mr. Leasure’s practice:
  • representation of a Bermuda-based reinsurer in litigation regarding the application of facultative reinsurance to a large property loss that also involved excess of loss cover
  • reviewing and drafting reinsurance contracts for captive insurance of health care companies
  • claims and litigation advice regarding health and accident reinsurance of 9/11-related claims for an intermediary and its clients
  • outsourced general counsel representation of small- to medium-sized brokers and reinsurance intermediaries, including contract review, vendor negotiation, and employment issues
  • representation of a major property insurer in the successful defense of a proposed class action involving general contractor overhead and profit through Pennsylvania state trial and appeals courts.
