Aline Fairweather

Aline Fairweather is a partner in the Philadelphia office of Pepper Hamilton LLP. She is a member of the Health Effects Litigation and Life Sciences practice groups. Ms. Fairweather advises and defends manufacturers of pharmaceutical products and medical devices, as well as life science companies with products in development.

Ms. Fairweather has represented clients in multidistrict federal litigation involving a wide variety of pharmaceutical products, and in responding to government investigations and inquiries. She has significant experience as national and regional coordinating counsel in mass torts litigation involving numerous firms and simultaneous discovery in a number of related proceedings, as well as serving as defense liaison counsel to the court on electronic discovery issues. She has extensive experience preparing product liability cases for trial, including deposing lead plaintiffs; preparing and defending senior company executives; and developing key expert witnesses on topics ranging from the biology and epidemiology of diabetes to FDA regulatory compliance. Ms. Fairweather has also served as trial counsel to clients involved in other kinds of litigation, including defending a hospital and its physicians against a wrongful death action that resulted in a jury verdict for Pepper’s clients, and representing a specialty metals manufacturer in an eminent domain and environmental cost recovery action.

Along with defending health care clients against litigation, Ms. Fairweather provides regulatory counseling on compliance with FDA regulations, and on potential regulatory and litigation issues raised by regulatory submissions, proposed labeling, clinical trial protocols and informed consents, securities prospectuses, and press materials. She has assisted clients in preparing responses to FDA inquiries and advised on regulatory issues in connection with commercial transactions.

Ms. Fairweather has spoken on a variety of legal issues impacting the health care sector, including expert opinion testimony. She is a contributing author to the Drug and Medical Device Product Liability Deskbook (J. Beck and A. Vale, eds.).

In her pro bono practice, Ms. Fairweather provides post-conviction representation to criminal defendants in capital cases. She represented a mentally disabled death row prisoner in one of the first successful challenges to a death sentence in Pennsylvania following the U.S. Supreme Court’s landmark decision in Atkins v. Virginia.

Ms. Fairweather is admitted to practice before the bars of Pennsylvania and New York, as well as the United States Supreme Court and a number of other federal courts. Before joining Pepper, Ms. Fairweather practiced with Simpson Thacher & Bartlett LLP in New York, and Dechert LLP in Philadelphia.
