Henry J. Jaffe

Henry Jaffe is a partner in the Corporate Restructuring and Bankruptcy Practice Group of Pepper Hamilton LLP, resident in the Wilmington and Philadelphia offices.

Mr. Jaffe represents various types of clients in bankruptcy matters, including debtors, trustees, creditors’ committees, and secured, unsecured and administrative claimants, and he has defended and prosecuted numerous avoidance actions in various jurisdictions throughout the country. Among his successful representations are those reported in Kleven v. Household Bank F.S.B., 334 F.3d 638 (7th Cir. 2003), and In re Pasteurized Eggs Corporation, 296 B.R. 283 (Bankr. D. N.H. 2003).

Mr. Jaffe is a frequent author and lecturer on various bankruptcy subjects. Since 2003, he has authored or co-authored the article covering recent case developments under section 547 of the Bankruptcy Code (preferences) for Norton’s Annual Survey of Bankruptcy Law. He also has published numerous articles on bankruptcy for the Legal Intelligencer.

He has lectured on bankruptcy topics and authored materials for the American Conference of Bankruptcy Judge’s annual meeting, the American Bankruptcy Institute’s Construction Law Subcommittee and the Pennsylvania Bar Institute. He also has prepared extensive bankruptcy materials for the Eastern District of Pennsylvania Bankruptcy Conference. Mr. Jaffe is a bench member of the Delaware Bankruptcy Inn of Court, for which he has appeared as a panelist and authored materials.

The representations in which Mr. Jaffe has been actively involved include the following:

  • serving as counsel to the creditors’ committee in the SyntaxBrillian case
  • serving as counsel to the liquidating trust in the Fleming Companies, Inc. case
  • serving as counsel to the creditors’ committee in Ashland Regional Medical Center, Inc.
  • serving as counsel to the debtor in the Vectour case
  • serving as counsel to the debtor in the Regal Communications case
  • serving as counsel to creditor in the Delphi, Dana, General Motors and Chrysler cases
  • serving as counsel to a committee member in the Metaldyne case
  • representation of creditor in Enron case
  • representation of creditor in MCI/WorldCom case
  • representation of creditor in Motor Coach Industries case
  • representation of creditor in the Linens ‘N Things case
  • representation of landlords in various cases in Delaware, including Ritz Camera and Hancock Fabrics
  • representation of secured creditors in various bankruptcy cases throughout the nation
  • representation of individual creditors in numerous cases in Delaware and throughout the nation
  • defense and prosecution of numerous adversary proceedings in Delaware and throughout the nation.

Mr. Jaffe is a member of the Delaware and Pennsylvania bars and is admitted to practice before the U.S. District Courts for the Districts of Delaware and Maryland, and the Eastern and Middle Districts of Pennsylvania.
